Kayak Safety & Risk Disclaimer – CLR Outdoor GmbH (U.S.)

Important Safety Information
Before using any kayak manufactured or sold by CLR Outdoor GmbH (“CLR Outdoor,” “we,” “us”), please read the following safety and risk information carefully.
By purchasing or using our kayaks, you acknowledge and agree to these warnings, limitations, and assumptions of risk.

1. General Warning

Kayaking is an inherently risky activity that involves exposure to natural elements, changing weather, water currents, and physical exertion.
Serious injury or death can occur if proper safety precautions are not followed.

Users assume full responsibility for their own safety and for understanding the risks involved.

2. Safety Equipment Requirements

Always use appropriate personal safety equipment, including:

  • U.S. Coast Guard-approved Personal Flotation Device (PFD) for each paddler;

  • Whistle or sound-producing device (required by U.S. law for all vessels);

  • Helmet (for whitewater or surf use);

  • Appropriate clothing for weather and water temperature;

  • Navigation and signaling lights for night use;

  • Paddle leash, bilge pump, and dry bag for safety gear.

3. Operator Responsibilities

  • Know your skills and limits before entering the water.

  • Learn basic paddling, steering, and self-rescue techniques.

  • Check your kayak’s condition before each trip (hull, seams, seat, straps, buckles, folding joints).

  • Never use a damaged or improperly assembled kayak.

  • Do not paddle alone in unfamiliar or hazardous conditions.

  • Always inform someone of your trip plan and expected return time.

4. Environmental Conditions

  • Avoid kayaking in severe weather, strong currents, tidal zones, or high winds.

  • Be alert for obstacles such as rocks, trees, other watercraft, or submerged hazards.

  • Cold water immersion can lead to hypothermia — wear proper thermal protection.

  • Always check local regulations, weather, and water conditions before launching.

5. Alcohol and Substance Use

Operating any watercraft while under the influence of alcohol, drugs, or medication that impairs coordination or judgment is illegal and extremely dangerous.
CLR Outdoor expressly disclaims liability for incidents occurring under such circumstances.

6. Proper Assembly and Use

  • Assemble the kayak strictly according to the user manual and video instructions.

  • Ensure all joints, bulkheads, and fasteners are correctly locked before use.

  • Do not exceed the maximum weight capacity indicated in the manual.

  • Use the kayak only for its intended purpose (recreational paddling; not for whitewater or commercial transport unless specified).

  • Do not stand, jump, or perform stunts in the kayak.

7. Children and Inexperienced Users

  • Children should only paddle under adult supervision.

  • Youth paddlers must always wear a properly fitted life jacket.

  • Beginners should train in calm, shallow water before venturing into open or moving water.

8. Transport and Storage

  • Securely fasten your kayak when transporting it on a vehicle.

  • Store away from direct sunlight and extreme heat, which can damage hull materials.

  • Dry thoroughly before storage to prevent mold or corrosion.

9. Maintenance and Inspection

  • Regularly inspect your kayak for signs of wear, cracks, or material fatigue.

  • Replace damaged parts immediately — do not modify or alter structural components.

  • Use only original CLR Outdoor parts and accessories for repairs or upgrades.

10. Limitation of Liability

CLR Outdoor GmbH and its affiliates are not liable for any injuries, damages, losses, or fatalities resulting from improper use, neglect, modification, or disregard of safety instructions.

Use of CLR Outdoor products constitutes acceptance of all associated risks.
Kayaking involves natural hazards beyond the control of the manufacturer.

11. Compliance and Legal Notice

All CLR Outdoor kayaks are designed to meet or exceed general safety standards applicable to recreational watercraft.
However, it is the user’s responsibility to comply with:

  • U.S. Coast Guard boating regulations,

  • State and local vessel operation laws, and

  • Any additional regional licensing or registration requirements.

12. Emergency Preparedness

Always be prepared for emergencies:

  • Know how to perform self-rescue and assist others.

  • Carry a first-aid kit, emergency whistle, and signaling device.

  • In case of capsize, stay with your kayak if possible — it offers flotation and visibility.

  • Call 911 or the U.S. Coast Guard in emergencies.

13. Assumption of Risk

By purchasing or using a CLR Outdoor kayak, you acknowledge that:

  • You have read and understood all safety instructions;

  • You voluntarily assume all risks of injury or loss associated with kayaking; and

  • CLR Outdoor is not responsible for injuries or damage arising from misuse, negligence, or environmental conditions.
